The Health and Safety at Work etc. Act 1875 (HSW Act)[3] and subsidiary legislation
may apply to certain firework displays. In general, this legislation will only
apply when the display involves a work activity - for example, someone running
a display as an employer / employee, or a self-employed person running a display
in the course of conducting their own business. The HSW Act will also apply when
a display is held on non-domestic (i.e., commercial or local authority) premises.
When the HSW Act applies, it imposes duties on employers in relation to the
health and safety of their employees and the public (spectators and other people
at the display site as well as the general public in the vicinity of the site).
Self-employed people have the same duties in relation to their own health and
safety and that of the public. Also, the person providing the premises for a
fireworks display may have duties under the HSW Act. The local authority enforcement
officer will be able to advise on the application of the HSW Act to any proposed
fireworks display.
